Code of Ethics of the Public Council of FAS

 

General provisions

Article 1

The Code of Ethics of the Public Council of FAS (hereinafter - the Code, the Public Council) establishes binding rules for each member of the Public Council in the exercise of his powers based on moral standards, respect for society and his colleagues.

Article 2

Members of the Public Council participate in the formation of civil society and the coordination of socially significant interests through objective and impartial public control over the FAS Russia activities, the promotion and support of civil initiatives, the examination of draft legal acts and the involvement of citizens and public associations in the implementation of public policy.

 

Standards of Conduct for Members of Public Council

Article 3

In the exercise of his powers a member of the Public Council is obliged to comply with the Constitution of the Russian Federation and other federal laws, as well as with this Code and generally accepted moral standards.

Article 4

In the exercise of his powers a member of the Public Council shall:

  1. Comply with public interests.
  2. Proceed from honest, reasonable, conscientious performance of his duties, treat colleagues with respect, trust and cooperation.
  3. Abstain in public debate from rude and incorrect expressions.
  4. Respect official national symbols of the Russian Federation.
  5. Respect the state language of the Russian Federation.
  6. Be concerned about the authority of the Public Council.
  7. Follow the principles of legality, impartiality and justice. Inform the Public Council about a possible conflict of interest.
  8. Respect the beliefs, traditions, cultural characteristics of ethnic and social groups, religions, promote interethnic and interfaith peace and harmony.
  9. Assist representatives of mass media in an objective coverage of the activities of the Public Council, as well as respect their professional activities.
  10. Prevent any non-official statements and appeals on behalf of the Public Council.
  11. Take part in the activities of the Public Council and its Working groups.
  12. Notify the Chairman and Executive Secretary of the Public Council before the meeting of the Public Council about his delay or inability to take part in the Public Council.

 

Responsibility for Violating the Code of Ethics

Article 5

A violation of the Code is the non-compliance or improper performance by a member of the Public Council of ethical standards of conduct established by this Code.

Article 6

In case of violation of the Code at a meeting of the Public Council, Commission, Working group and other events of the Public Council, the Chairman shall warn the speaker about such a violation. In case of repeated violation he is not allowed to speak during the entire meeting.

Article 7

In case of major violation by a member of the Public Council of Clauses 3.24-3.26 of the Regulation on the Public Council of the Federal Antimonopoly Service, approved by the FAS Russia Order No. 68/17 of January 30, 2017, his powers can be terminated.

Article 8

A major violation is a violation of the provisions established by this Code committed by a member of the Public Council in the exercise of his powers, which has an adverse effect on the goals and objectives of the Public Council, the image, business reputation of the Public Council and/or its members; as well as the avoidance to participate in the activities of the Public Council and its Working groups, including systematic (3 or more) missed meetings.

 

The Conflict of Interest

Article 9

Conflict of interest means a situation when the personal interest of a member of the Public Council or the impact (pressure) on a member of the Public Council affects or may affect the proper exercise of his powers and when a conflict arises or may arise between the personal interest of a member of the Public Council and the legitimate interests of Russian citizens, public associations, reference groups, that can cause harm to these legitimate interests.

Article 10

Personal interest of a member of the Public Council, which affects or may affect the proper exercise of his powers, is the possibility of a member of the Public Council to receive income (unjust benefit) in cash or in kind, income in the form of material benefit for a member of the Public Council, members of his family or close relatives, as well as for citizens of the Russian Federation or public associations with which a member of the Public Council is bound financially or by other commitments.

Article 11

Members of the Public Council are obliged to inform in writing the Chairman of the Public Council and the Head of the FAS Russia before April 30 annually that they have no conflict of interest, and new members of the Public Council shall inform about the absence of conflict of interest when they are included in the Public Council.

Article 12

If a member of the Public Council has a personal interest that leads or may lead to a conflict of interests, or if there is an impact (pressure) on a member of the Public Council related to the exercise of his powers, a member of the Public Council is obliged to report this as soon as possible in writing to the Chairman of the Public Council, and the Chairman of the Public Council - to the Civic Chamber of the Russian Federation.

Article 13

The Chairman of the Public Council, the Government Expert Council or the Civic Chamber of the Russian Federation, that became aware of a personal interest of a member of the Public Council or the Chairman of the Public Council, which leads or may lead to a conflict of interest, is obliged to take measures to prevent or resolve a conflict of interest by up to the relieving him from the duties as a member of the Public Council or the Chairman of the Public Council, which is a party to the conflict of interests, in the manner established by the Government Expert Council and the Civic Chamber of the Russian Federation.

 

Final Provisions

Article 14

This Code applies to members of the Public Council.

Regarding the relations that are not regulated by this Code and the legislation of the Russian Federation, members of the Public Council shall be guided by moral principles.

Article 15

Amendments to the Code are adopted by a majority vote of the total number of members of the Public Council and approved by the Chairman of the Public Council under the FAS Russia.

Decisions of the Public Council on amendments to the Code shall enter into force on the day of their adoption, unless the Public Council decides otherwise.
